Please read these Terms of Use carefully before using the Poffykids app. By downloading, opening, using, or accessing any feature inside Poffykids, you accept these Terms of Use and the Privacy Policy available inside the app.

Because Poffykids provides an educational and play experience intended for children, use of the app by child users should take place under the supervision of a parent or legal guardian. The person accepting these Terms of Use is considered to be the parent or legal guardian acting on behalf of the child user.

DEFINITIONS

“App” means the Poffykids mobile children’s learning app, including the games, levels, audiovisual content, settings, subscription screens, and related services inside the app.

“We”, “us”, or “Poffykids” means the developer that provides the Poffykids app and related services.

“User” means the person using the app and, for child users, the relevant parent or legal guardian.

“Content” means the text, images, animations, sounds, characters, game design, interfaces, levels, and all other materials in the app.

PURPOSE OF THE APP

Poffykids is designed to support preschool and early-learning children as they practice numbers, simple instructions, attention skills, and repetition through play. The app is an educational support tool; it is not a substitute for professional education, developmental assessment, medical advice, or therapy.

We do not guarantee that the content in the app will produce the same learning result for every child. If you have concerns about your child’s development, learning process, or special needs, you are encouraged to consult an appropriate professional.

PARENT AND GUARDIAN RESPONSIBILITY

Poffykids aims to provide children with a safe and simple experience. However, downloading the app, purchases, subscription management, sending support requests, using links outside the app, and managing device settings are the responsibility of the parent or legal guardian.

As a parent or legal guardian, you are responsible for ensuring that the child uses the app in a way that is appropriate for the child’s age, needs, and safety. When adult-facing actions or external links are provided inside the app, they are intended to be used with parental control.

LICENSE AND RIGHT OF USE

Poffykids grants you a personal, limited, non-transferable, non-exclusive, and non-commercial right to use the app. The app is not sold to you; it is licensed only for use in accordance with these Terms of Use and the rules of the platform from which the app was obtained.

For versions downloaded through the App Store, Apple’s App Store rules and, where applicable, Apple’s Standard End User License Agreement may also apply. If there is a mandatory difference between these Terms of Use and App Store or Apple rules, the relevant platform rules and applicable law will be taken into account.

ACCEPTABLE USE

You may use the app only for lawful, safe, and personal purposes. The following conduct is prohibited:

• Copying, selling, renting, redistributing, or commercially using the app or its content

• Trying to extract the source code, reverse engineer, modify, or create unauthorized derivative works from the app

• Trying to bypass the app’s security, access controls, subscription, or unlock mechanisms

• Using the app in an unlawful, harmful, misleading, or rights-infringing way

• Using automation, bots, attacks, manipulation, or technical interference that disrupts normal operation of the app

• Misusing support or communication channels inside the app

CONTENT AND INTELLECTUAL PROPERTY

All content, designs, game structures, characters, text, sounds, images, interfaces, software code, brand elements, and other materials in Poffykids belong to us or the relevant rights holders, or are used under license.

These Terms of Use do not give you any intellectual property rights other than the right to use the app. The Poffykids name, app content, and related brand elements may not be used, copied, or transferred to third parties without permission.

IN-APP PURCHASES AND SUBSCRIPTIONS

Poffykids may offer in-app purchases or subscription options for access to certain games, levels, features, or unlimited access options. Purchases and subscriptions are handled through the App Store and Apple’s payment infrastructure.

If a subscription is offered, the subscription period, price, renewal period, and provided access are shown on the purchase screen. Subscriptions may automatically renew at the end of the relevant period unless canceled. Subscription management, cancellation, payment method changes, and renewal preferences are handled through your Apple ID account or App Store subscription settings.

Fees, taxes, currency conversions, payment confirmations, billing information, and refund processes are managed under Apple’s rules and relevant platform policies. Poffykids does not directly view or store your payment card information.

UPDATES AND CHANGES

We may update the app from time to time to improve Poffykids, fix bugs, increase security, add new content, or improve existing features. Some features may be changed, suspended, or removed.

For the app to work properly, your device, operating system, and App Store account may need to support the required updates. If you do not install updates, some features may not work or your access may be limited.

THIRD-PARTY SERVICES

The app may interact with third-party services such as the App Store, Apple payment infrastructure, email providers, or device operating system features. Use of these services may be subject to the relevant third parties’ own terms and policies.

We may not have full control over interruptions, decisions, refund processes, payment confirmations, or account management actions of third-party services. Therefore, to the extent permitted by applicable law, we may not be responsible for issues caused by third-party services.

PRIVACY

Poffykids’ information processing practices are explained in the Privacy Policy available inside the app. Using the app also means that you accept the Privacy Policy.

The privacy of child users is important to us. We do not aim to knowingly collect children’s personal information, and we try to design the app for children with limited data use.

LIMITATION OF WARRANTIES

We make reasonable efforts to keep Poffykids safe, enjoyable, and working. However, to the extent permitted by applicable law, the app is provided “as is” and “as available”.

We do not guarantee that the app will be uninterrupted, error-free, perform the same on every device, guarantee a specific educational result, or meet all user expectations. Your mandatory consumer rights and rights under applicable law remain reserved.

LIMITATION OF LIABILITY

To the extent permitted by applicable law, our liability may be limited for indirect, incidental, special, consequential damages, data loss, revenue loss, device or software issues, or damages arising from third-party services caused by the use of, or inability to use, Poffykids.

Nothing in these Terms may be interpreted to remove consumer rights that cannot be limited by law, liability that may arise from gross negligence or intent, or mandatory rules of applicable law.

ACCOUNT, DATA, AND LOCAL RECORDS

In its current structure, Poffykids is not intended to provide account creation or public profile systems for children. Some information such as game progress, sound and music preferences, and access status may be stored locally on your device.

Deleting the app, changing your device, resetting device settings, or clearing local data may cause some progress and settings information to be lost. Purchases or subscriptions made through the App Store are managed through your Apple account.

TERMINATION

If you violate these Terms of Use, misuse the security or operation of the app, or act unlawfully, we may limit or terminate your access to the app or certain features to the extent permitted by applicable law.

You may stop using the app by deleting it from your device. Termination of use does not remove obligations that arose before termination or provisions that should remain in effect.

CHANGES TO THE TERMS

These Terms of Use may be updated from time to time. If significant changes are made, notice may be provided in the app or on our website where appropriate. The current terms will remain accessible inside the app.

Continuing to use Poffykids after changes means that you accept the current Terms of Use. If you do not accept the changes, you should stop using the app.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms of Use are interpreted subject to mandatory consumer protection rules, child safety rules, and data protection provisions. In any dispute, laws that must apply in the user’s location and competent authorities may be taken into account.
